According to the Multi-employer Agreement, you are meant to get a day in lieu when a public
holiday falls on one of your scheduled days off.
An eagle-eyed member has alerted us to the fact that this has not been happening at Devonfield.
If, for example, Mondays are one of your scheduled days off and the King’s Birthday public
holiday falls on a Monday, you should be provided with a day in lieu and there should be a record
kept by Devonfield of these days.
Devonfield have refused to respond to our concerns, so we’ve now formally escalated a dispute
under the dispute resolution procedure. If Devonfield continue to keep their head in the sand,
we’ll promptly take the matter to the Fair Work Commission.
We’ve demanded Devonfield acknowledge its wrong-doing and commit to auditing and
providing members with a revised balance of days in lieu when public holidays fall on scheduled
days off.
